Please take the time to read the rules below (“Giveaway Rules”) before taking part in the reebee Days of Christmas 2023 Giveaway (the “Giveaway”).
Summary of the Giveaway Rules

- VOID WHERE PROHIBITED BY LAW
- Open only to residents of Canada
- Open only to individuals who are of the age of majority in their province or territory as of Friday, December 1, 2023.
- Giveaway begins on December 1, 2023 at 12:00AM ET and ends on December 24, 2023 at 11:59PM ET (the “Giveaway Period”).
- There will be 24 draws in total (each, a “Draw”): one for each day of the Giveaway (where a day is the 24 hour period of 12:00AM ET to 11:59PM ET) (each, a “Giveaway Day”), at or around 10:00AM ET, on the business day following the relevant Giveaway Day (the “Draw Time(s)”).
- The final draws (for the December 21-24, 2023 Giveaway Days) will take place at 10:00AM ET on Wednesday, December 27, 2023.
- An Entrant will be selected from the entries collected only for that Giveaway Day (00:00 ET to 23:59 ET) (each, a “Winner”).
- Prizes for each Giveaway Day will be valued at approximately CAD $500 (the “Prize(s)”).
- Odds of winning depend on number of valid entries received.
- Skill-testing question will be required.

Full Giveaway Rules
THE GIVEAWAY IS OPEN TO LEGAL RESIDENTS OF CANADA ONLY. PARTICIPANTS MUST BE OF THE AGE OF MAJORITY IN THEIR PROVINCE, TERRITORY OR STATE OF RESIDENCE OR OLDER AT THE TIME OF ENTRY. DO NOT ENTER THIS GIVEAWAY IF YOU ARE NOT ELIGIBLE.
NO PURCHASE IS NECESSARY TO ENTER THE GIVEAWAY.
THIS GIVEAWAY SHALL BE VOID, IN WHOLE OR IN PART, WHERE PROHIBITED BY LAW.
ENTRY IN THIS GIVEAWAY CONSTITUTES YOUR ACCEPTANCE OF THE GIVEAWAY RULES.
Eligibility
To be eligible for this Giveaway, an individual must:
- be a legal resident of Canada; and
- be of the age of majority in their province or territory at the time of commencement of the Giveaway Period.
Employees and representatives of the Sponsor, its respective affiliates, subsidiaries, related companies, advertising and promotional agencies and contest administrators, and any individual residing in the same household as any of the previously listed persons are not eligible to participate in the Giveaway.
The Giveaway Period
Giveaway begins on December 1, 2023 at 12:00AM ET and ends on December 24, 2023 at 11:59PM ET.
How to Enter
There is no purchase necessary to enter the Giveaway. To enter, each eligible individual (“Entrant”) must, on each day on which the Entrant wishes to enter the Giveaway:
- submit the Giveaway entry form via the Giveaway web page. First name, last name, email, province, and language preference are the required fields for every Giveaway day. It is a condition of entry that the aforementioned fields are completed fully and accurately. Email list signups are optional and will not increase chances of winning; and
- click to view the featured flyer/ad or deal from the Giveaway web page (together, the “Tasks”).
There is a limit of 1 [one] ballot entry per Giveaway day per eligible Giveaway Entrant for the duration of the Giveaway. If you attempt, or are reasonably suspected by the Sponsor of attempting to enter more than the 1 [one] allowable time or of using robotic, automatic, programmed or any entry methods not authorized by these rules, it shall be deemed as tampering and will void all your entries.
If you have completed the Tasks, you will be automatically entered into the Giveaway. The completed Tasks equals one (1) entry into the Giveaway for the relevant Giveaway Day. A random draw will be conducted to draw the Selected Entrant (defined below) of the Draw. Entries are only eligible for the Draw on a particular Giveaway Day if received during that Giveaway Day.
To obtain one (1) entry in the Giveaway without needing to complete the Tasks, print your first name, last name, complete mailing address (including postal/zip code), valid email address and telephone number on a plain piece of paper and mail it (in an envelope with sufficient postage) to: Flipp Operations Inc., 350-3250 Bloor St W, Toronto, ON, M8X 2X9. Attn: Consumer Research – December [XX], 2023 reebee Days of Christmas Giveaway Entry (the “Request”). Upon receipt of a valid Request in accordance with these Rules, you will receive one (1) entry in the Giveaway. As above, entries are limited to one (1) entry per person per Giveaway Day. To be eligible to enter a Draw, the Request must: (i) be received separately in an envelope bearing sufficient postage (i.e. multiple Requests in the same envelope will be void); and (ii) be post-marked during the relevant Giveaway Day and received by no later than the end of the relevant Giveaway Day.
Conditions of Entry
By entering, Entrants agree to accept, abide by and acknowledge compliance with these Giveaway Rules, including but not limited to all eligibility requirements, and the decisions of Sponsor, which rules and decisions are final and binding on all Entrants.
Entrants agree to abide by all the terms and conditions of Instagram and any other third-party platform, as applicable.
Entrants agree that Sponsor is free to use any information provided to Sponsor in accordance with these Giveaway Rules, including, but not limited to, the uses as outlined in the section entitled “Privacy and Use of Personal Information”.
The Draws
On or about the Draw Time, Sponsor will randomly select one (1) Entrant from the pool of eligible Entrants for the relevant Giveaway Day (each a “Selected Entrant”).
Odds of winning are dependent on the number of eligible entries received and the number of Entrants on the respective platform.
Prizes
The Prize for each Giveaway Day is valued at approximately CAD $500. The Prizes will be sent to the winners via email or mail. The Giveaway is divided into 24 [twenty-four] daily draw dates. Each day will offer 1 [one] sponsored prize. There will be a total of 24 [twenty-four] Giveaway Winners, winning an estimated combined total retail value of $12,000.00 CAD.
Sponsor reserves the right to substitute an alternate prize of equal or greater value if an advertised prize is unavailable at the time of award.
On some Giveaway days, different provinces or territories will display a different affiliated retailer. Depending on the Giveaway Entrant’s location, the Giveaway page will direct Entrants to the correct Entry Page for their province or territory. Should a Giveaway day have more than one [1] affiliated retailer, the province or territory of the Winner (as indicated by the postal code entered into the Giveaway form) will determine the prize won.
Additional Conditions for Winning
Each Selected Entrant must also correctly answer unaided, a time limited, mathematical, skill-testing question and sign a standard declaration and release form.
Failure to comply with all the terms and conditions in the Giveaway Rules will result in disqualification and an alternate Entrant will be selected in accordance with these Giveaway Rules.
Any attempt or suspected attempt to use robotic, automatic, programmed or otherwise illicit means to enter the Giveaway, or any other methods not authorized by these Giveaway Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. Entries that contain false or incomplete information are void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Giveaway Rules are void. Entrants grant Sponsor a non-exclusive license to use all entries for any purpose. No correspondence will be entered into except with Selected Entrants. Proof of transmission (for example, screenshots or captures) does not constitute proof of entry or receipt of an entry.
The Sponsor reserves the right to terminate or amend this Giveaway at any time and in any way, without prior notice to entrants. Without limiting the foregoing, if, for any reason, the Giveaway is not capable of running as originally planned for any reason, the Sponsor reserves the right to cancel the Giveaway and conduct a random draw from all previously-received eligible entries received during the relevant Giveaway Day or Giveaway Period, as applicable.
Prize Redemption
Each Selected Entrant will be notified via email within five (5) business days of the Draw Time. The Selected Entrant must respond within five (5) business days of the notification with all the information requested.
Examples of required information includes, but is not limited to:
- Selected Entrant’s mailing address
- Selected Entrant’s email address
- Selected Entrant’s place of residence (country and state/province/territory)
- Selected Entrant’s age; and
- The correct answer to the mathematical skill-testing question
As a prerequisite for receiving the prize, each Selected Entrant shall also be required to sign a declaration and release form. The completed and signed copy of the declaration and release form may be sent (i) via email (i.e. in scanned format such as Adobe® PDF), (ii) via courier or registered mail, or (iii) via fax (number to be provided in the notice). Failure to provide a full and valid response (such as not providing all information requested, not executing the declaration and release form to the full satisfaction of the Sponsor or for Canadian residents, failing to answer the mathematical skill-testing question correctly) will result in the Selected Entrant being disqualified and an alternative Entrant being selected in accordance with the Giveaway Rules. No extension will be given, regardless of the circumstances. There are no exceptions; please do not ask. The Sponsor is not responsible for a Selected Entrant’s failure to respond to the notice in a timely manner or to provide an incomplete or incorrect response.
THE DECLARATION AND RELEASE FORM IS AN IMPORTANT LEGAL DOCUMENT SO PLEASE READ CAREFULLY. THE FORM INCLUDES, AMONG OTHER THINGS, (I) A RELEASE IN FAVOUR OF THE SPONSOR THAT ABSOLVES THE SPONSOR FROM ANY AND ALL LIABILITY FOR ANY LOSS, HARM, DAMAGES, COST OR EXPENSE ARISING OUT OF PARTICIPATION IN THIS GIVEAWAY, (II) AN INDEMNITY FOR THE BENEFIT OF THE SPONSOR FOR ANY DAMAGES, COST OR EXPENSES SUFFERED BY THE SPONSOR FROM A SELECTED ENTRANT’S BREACH, NEGLIGENCE OR MISCONDUCT IN CONNECTION WITH ITS PARTICIPATION IN THE GIVEAWAY, AND (III) A DECLARATION TO CERTAIN FACTS UPON WHICH THE SPONSOR RELIES FOR THE PURPOSE OF CONDUCTING THE GIVEAWAY. THE SPONSOR ENCOURAGES YOU TO SEEK PROFESSIONAL LEGAL OPINION BEFORE EXECUTING THE DOCUMENT.
Within a reasonable time following the receipt of a Selected Entrant’s full and valid response, the Sponsor shall send the respective Prize to the Selected Entrant. The Sponsor is not responsible if the Prize is lost, stolen or mutilated. No replacement will be provided. The value of the prize may be taxable as income; any and all applicable taxes, fees, duties and surcharges on the Prize and/or the redemption thereof are the sole responsibility of the applicable Selected Entrant.
Privacy and Use of Personal Information
By participating in the Giveaway, Entrant (a) grants to the Sponsor the right to use all information provided to the Sponsor in connection with the Giveaway, including, but not limited to, the Entrant’s name and e-mail address (“Personal Information”) for the purpose of administering the Giveaway; and (b) acknowledges that the Sponsor may disclose his/her Personal Information to third-party agents and service providers of any of the Sponsor for the purpose of administering the Giveaway.
The Sponsor will use the Entrant’s Personal Information only for identified purposes, and protect the Entrant’s Personal Information in a manner that is consistent with its privacy policy. The Entrant will at all times have control over its Personal Information and will be provided with a mechanism to unsubscribe to any further communications from the Sponsor. The Sponsor will not use Entrant’s Personal Information for any other purpose.

This Section shall survive the termination or expiry of the Giveaway.
Exclusion of Warranties; Limitation of Liabilities; Indemnities
In this Section, the term “Sponsor” (as defined below) includes its subsidiaries, affiliates, advertising and promotional agencies, and all of their officers, directors, employees, representatives and agents.
No Warranties: TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PRIZES AND ANY SYSTEMS, WEBSITES AND TECHNOLOGIES USED IN CONNECTION WITH THE PROVISION OF THE GIVEAWAY ARE PROVIDED “AS-IS”. ENTRANT’S USE OF THE PRIZES AND SUCH SYSTEMS, WEBSITES AND TECHNOLOGIES IS AT ITS SOLE RISK WITH NO WARRANTIES (INCLUDING IMPLIED, EXPRESS OR STATUTORY) WHATSOEVER.
Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPONSOR SHALL HAVE NO LIABILITY TO THE ENTRANT FOR PERSONAL INJURY, OR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES WHATSOEVER, IN CONNECTION WITH OR ARISING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES OR PARTICIPATION IN THIS GIVEAWAY OR PARTICIPATION IN ANY GIVEAWAY OR PRIZE RELATED ACTIVITY. FOR ANY LIABILITY OF THE SPONSOR NOT LIMITED BY THIS SECTION, AND TO THE EXTENT NOT PROHIBITED BY LAW, THE SPONSOR’S TOTAL LIABILITY TO EACH ENTRANT FOR ALL DAMAGES SHALL BE LIMITED TO TEN DOLLARS ($10.00) AND TO ALL ENTRANTS IN THE AGGREGATE SHALL BE LIMITED TO FIFTY DOLLARS ($50.00).
Indemnity: Entrant agrees to indemnify, defend and hold harmless Sponsor from any damages, losses, costs and expenses (including legal fees), incurred in connection with or arising from Entrant’s participation in the Giveaway, breach or alleged breach of the Giveaway Rules, and/or any negligence or misconduct in connection with the participation in the Giveaway. Sponsor reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by Entrant hereunder, and Entrant shall cooperate fully as reasonably required by Sponsor.
This Section shall survive the termination or expiry of the Giveaway.
Miscellaneous
The Sponsor reserves the right, in its sole discretion, to terminate the Giveaway, in whole or in part, and/or modify, amend or suspend the Giveaway, and/or the Giveaway Rules in any way, at any time, for any reason without prior notice. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, theft or destruction or unauthorized access to, or alteration of, entries.
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY UNDERMINE, JEOPARDIZE OR IN ANY WAY DISRUPT THE LEGITIMATE OPERATION OF THIS GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW AND/OR CANCEL, TERMINATE, MODIFY OR SUSPEND THE GIVEAWAY.
Whenever possible, each provision of these Giveaway Rules shall be interpreted so as to be effective and valid under applicable law. If, however, any provision of these Giveaway Rules is held to be prohibited by, or invalid under, applicable law, such provision shall be ineffective only to the extent of such prohibition or invalidity, without invalidating the remainder of such provision or the other provisions of these Giveaway Rules.
This Section shall survive the termination or expiry of the Giveaway.

Governing Law
This Giveaway is governed by the laws of the Province of Ontario without regard to its conflict of laws principles. Entrants agree that all disputes, controversies or differences whatsoever arising in connection with the Giveaway and the Giveaway Rules shall be adjudicated exclusively in and before a court located in Toronto, Ontario. Entrants knowingly and voluntarily waive their rights to have any disputes, controversies or differences tried and adjudicated by a jury.
This Section shall survive the termination or expiry of the Giveaway.
Language Discrepancy
In the event of any discrepancy or inconsistency between the terms and conditions of the Giveaway Rules and disclosures or other statements contained in any Giveaway-related materials, including but not limited to the Giveaway entry form, and print or online advertising, the terms and conditions of the Giveaway Rules shall prevail, govern and control.
This Section shall survive the termination or expiry of the Giveaway.

Admissibilité
Pour être admissible pour ce concours, un individu doit:
- Être un(e) résident(e) légal(e) du Canada; et
- Avoir atteint l’âge de la majorité. Dans leur province ou leur territoire au moment du début de la Période de Concours.
Les employé(e)s et représentant(e)s du Commanditaire, de ses filiales, de ses sociétés affiliées, des entreprises liées, des agences de publicité et de promotion, des administrateurs de concours, et toute personne résidant dans le même foyer que l’une des personnes précédemment énumérées ne sont pas admissibles à participer au Concours.
Période du concours
Le Concours débute le 1er décembre 2023 à 00h00 (HE) et se termine le 24 décembre 2023 à 23h59 (HE).
Comment participer
Aucun achat n’est nécessaire pour participer au Concours. Pour participer, chaque individu admissible (« Participant ») doit, chaque jour où il souhaite participer au concours :
- Soumettre le formulaire de participation du Concours via la page web du Concours. Le prénom, le nom, l’adresse courriel, la province et la préférence de langue sont les champs obligatoires pour chaque jour du Concours. Il est conditionnel à la participation que les champs susmentionnés soient remplis de manière complète et précise. Les inscriptions à la liste de diffusion par courriel sont facultatives et n’augmenteront pas les chances de gagner ; et
- Cliquer pour voir la circulaire/annonce en vedette ou l’offre à partir de la page web du Concours (ensemble, les « Tâches »).
Il est limité à un [1] bulletin de participation par jour de Concours par Participant admissible pour la durée du Concours. Si vous tentez, ou si le Commanditaire a des raisons raisonnables de soupçonner que vous tentez de participer plus d’une [1] fois ou d’utiliser des méthodes d’inscription robotiques, automatiques, programmées ou non autorisées par ces règles, cela sera considéré comme une tentative de manipulation et annulera toutes vos participations.
Si vous avez accompli les Tâches, vous serez automatiquement inscrit au Concours. Les Tâches accomplies équivalent à une (1) participation au Concours pour le Jour de Concours correspondant. Un tirage au sort aléatoire sera effectué pour sélectionner le/la Participant(e) Choisi(e) (défini ci-dessous) du Tirage. Les participations ne sont éligibles que pour le Tirage au Sort d’un Jour de Concours particulier si elles sont reçues pendant ce Jour de Concours.
Pour obtenir une (1) participation au Concours sans avoir à accomplir les Tâches, imprimez votre prénom, nom, adresse postale complète (y compris le code postal), adresse électronique valide et numéro de téléphone sur une feuille de papier ordinaire et envoyez-la (dans une enveloppe affranchie) à : Flipp Operations Inc., 350-3250 Bloor St W, Toronto, ON, M8X 2X9. À l’attention de : Consumer Research – [XX] décembre 2023 Concours Jours de Noël reebee Participation (la “Demande”). À la réception d’une Demande valide conformément à ces Règles, vous recevrez une (1) participation au Concours. Comme indiqué ci-dessus, les participations sont limitées à une (1) participation par personne par Jour de Concours. Pour être éligible à un Tirage au Sort, la Demande doit : (i) être reçue séparément dans une enveloppe portant un affranchissement suffisant (c’est-à-dire que plusieurs Demandes dans la même enveloppe seront nulles) ; et (ii) être postée pendant le Jour de Concours pertinent et reçue au plus tard à la fin du Jour de Concours pertinent.
Conditions d’entrée
En participant, les Participants acceptent, respectent et reconnaissent se conformer à ces Règles du Concours, y compris, mais sans s’y limiter, toutes les exigences d’admissibilité, et aux décisions du Commanditaire, lesquelles règles et décisions sont finales et contraignantes pour tous les Participants.
Les Participants acceptent de respecter l’ensemble des termes et conditions d’Instagram et de toute autre plateforme tierce, le cas échéant.
Les Participants acceptent que le Commanditaire soit libre d’utiliser toutes les informations fournies au Commanditaire conformément à ces Règles du Concours, y compris, mais sans s’y limiter, les utilisations telles que décrites dans la section intitulée «Confidentialité et utilisation des Informations Personnelles».
Les tirages
À l’Heure du Tirage au Sort, le Commanditaire sélectionnera de manière aléatoire un(e) (1) Participant(e) parmi le groupe de Participants admissibles pour le Jour du Concours concerné (chacun un(e) « Participant(e) Sélectionné(e) »).
Les chances de gagner dépendent du nombre de participations admissibles reçues et du nombre de Participants sur la plateforme respective.
Prix
Le Prix pour chaque Jour du Concours est évalué à environ 500$ CAD. Les Prix seront envoyés aux gagnants par courrier électronique ou par la poste. Le Concours est divisé en 24 [vingt-quatre] dates de tirage quotidiennes. Chaque jour offrira 1 [un] prix commandité. Il y aura un total de 24 [vingt-quatre] Gagnants du Concours, remportant une valeur au détail totale estimée de 12 000,00$ CAD.
Le Commanditaire se réserve le droit de substituer un autre prix d’une valeur égale ou supérieure si un prix annoncé n’est pas disponible au moment de l’attribution.
Certains Jours du Concours, différentes provinces ou territoires afficheront un détaillant affilié différent. Selon l’emplacement du Participant du Concours, la page du Concours dirigera les Participants vers la Page d’Inscription correcte pour leur province ou territoire. Si un Jour du Concours a plus d’un [1] détaillant affilié, la province ou le territoire du Gagnant (tel qu’indiqué par le code postal saisi dans le formulaire du Concours) déterminera le prix remporté.
Conditions supplémentaires pour gagner
Chaque Gagnant(e) Sélectionné(e) doit également répondre correctement, sans aide, à une question mathématique limitée dans le temps et signer un formulaire de déclaration et de décharge standard.
Le non-respect de toutes les modalités des Règles du Concours entraînera une disqualification et un(e) autre Participant(e) sera sélectionné(e) conformément à ces Règles du Concours.
Toute tentative ou suspicion de tentative d’utiliser des moyens robots, automatiques, programmés ou illicites pour participer au Concours, ou tout autre moyen non autorisé par ces Règles du Concours, par exemple, mais sans s’y limiter, la création de plusieurs comptes, identités ou inscriptions, tous à la seule discrétion du Commanditaire, sera considérée comme une tentative de manipulation et pourrait vous disqualifier de la participation et/ou de la victoire d’un prix. Les participations contenant des informations fausses ou incomplètes sont nulles. Les participations tardives, perdues, volées, illisibles, contenant des informations fausses, endommagées, mal orientées, mutilées, brouillées ou incomplètes, modifiées ou autrement irrégulières ou ne satisfaisant pas à toutes les conditions des Règles du Concours sont nulles. Les participants accordent au Commanditaire une licence non exclusive pour utiliser toutes les participations à toute fin. Aucune correspondance ne sera échangée sauf avec les Gagnants Sélectionnés. La preuve de transmission (par exemple, captures d’écran) ne constitue pas une preuve d’entrée ou de réception d’une entrée.
Le Commanditaire se réserve le droit de mettre fin ou de modifier ce Concours à tout moment et de quelque manière que ce soit, sans préavis aux participants. Sans limiter ce qui précède, si, pour une raison quelconque, le Concours ne peut pas se dérouler comme prévu pour une raison quelconque, le Commanditaire se réserve le droit d’annuler le Concours et de procéder à un tirage au sort parmi toutes les participations admissibles précédemment reçues pendant la Journée ou la Période du Concours pertinente, selon le cas.
Réception du Prix
Chaque Gagnant(e) Sélectionné(e) sera informé(e) par courriel dans un délai de cinq (5) jours ouvrables après l’Heure du Tirage. Le/la Gagnant(e) Sélectionné(e) doit répondre dans les cinq (5) jours ouvrables suivant la notification avec toutes les informations demandées.
Exemples d’informations requises, mais sans s’y limiter :
- Adresse postale du/de la Gagnant(e) Sélectionné(e)
- Adresse e-mail du/de la Gagnant(e) Sélectionné(e)
- Lieu de résidence du/de la Gagnant(e) sélectionné(e) (pays et état/province/territoire)
- Âge du/de la Gagnant(e) Sélectionné(e) ; et
- La bonne réponse à la question mathématique d’habileté.
En tant que condition préalable à la réception du prix, chaque Gagnant(e) Sélectionné(e) devra également signer un formulaire de déclaration et de libération. La copie complétée et signée du formulaire de déclaration et de libération peut être envoyée (i) par courrier électronique (c’est-à-dire au format numérisé tel que Adobe® PDF), (ii) par coursier ou courrier recommandé, ou (iii) par télécopie (le numéro sera fourni dans l’avis). Le fait de ne pas fournir une réponse complète et valide (comme ne pas fournir toutes les informations demandées, ne pas exécuter le formulaire de déclaration et de libération à la pleine satisfaction du Commanditaire ou, ne pas répondre correctement à la question mathématique d’habileté) entraînera la disqualification du/de la Gagnant(e) Sélectionné(e) et la sélection d’un(e) autre Gagnant(e) conformément aux Règles du Concours. Aucune prolongation ne sera accordée, quelle que soit la situation. Aucune exception ne sera faite; veuillez ne pas demander. Le Commanditaire n’est pas responsable du défaut du/de la Gagnant(e) Sélectionné(e) de répondre à l’avis en temps opportun ou de fournir une réponse incomplète ou incorrecte.
LE FORMULAIRE DE DÉCLARATION ET DE LIBÉRATION EST UN DOCUMENT JURIDIQUE IMPORTANT, ALORS VEUILLEZ LIRE ATTENTIVEMENT. LE FORMULAIRE COMPREND, ENTRE AUTRES CHOSE, (I) UNE DÉCHARGE EN FAVEUR DU COMMANDITAIRE QUI LE DÉGAGE DE TOUTE RESPONSABILITÉ POUR TOUTE PERTE, DOMMAGE, PRÉJUDICE, COÛT OU DÉPENSE DÉCOULANT DE LA PARTICIPATION À CE CONCOURS, (II) UNE INDEMNITÉ AU BÉNÉFICE DU COMMANDITAIRE POUR TOUT DOMMAGE, COÛT OU DÉPENSE SUBI PAR LE COMMANDITAIRE EN RAISON DE LA RUPTURE, DE LA NÉGLIGENCE OU DU MAUVAIS COMPORTEMENT D’UN GAGNANT SÉLECTIONNÉ DANS LE CADRE DE SA PARTICIPATION AU CONCOURS, ET (III) UNE DÉCLARATION DE CERTAINS FAITS SUR LESQUELS LE COMMANDITAIRE S’APPUIE POUR LA CONDUITE DU CONCOURS. LE COMMANDITAIRE VOUS ENCOURAGE À CONSULTER UN AVOCAT AVANT DE SIGNER LE DOCUMENT.
Dans un délai raisonnable suivant la réception d’une réponse complète et valide d’un(e) Gagnant(e) Sélectionné(e), le Commanditaire enverra le Prix respectif au/à la Gagnant(e) Sélectionné(e). Le Commanditaire n’est pas responsable si le Prix est perdu, volé ou mutilé. Aucun remplacement ne sera fourni. La valeur du prix peut être imposable en tant que revenu; toutes les taxes, frais, droits et surtaxes applicables sur le Prix et/ou son échange sont de la seule responsabilité du/ de la Gagnant(e) Sélectionné(e) concerné(e).
Confidentialité et utilisation d’informations personnelles
En participant au Concours, le/la Participant(E) (a) accorde au Commanditaire le droit d’utiliser toutes les informations fournies au Commanditaire dans le cadre du Concours, y compris, mais sans s’y limiter, le nom et l’adresse e-mail du/de la Participant(e) (« Informations personnelles ») aux fins de l’administration du Concours ; et (b) reconnaît que le Commanditaire peut divulguer ses Informations Personnelles à des agents et fournisseurs de services tiers du Commanditaire dans le but d’administrer le Concours.
Le Commanditaire utilisera les Informations Personnelles du/de la Participant(e) uniquement aux fins identifiées et protégera les Informations Personnelles du/de la Participant(e) de manière conforme à sa politique de confidentialité. Le/la Participant(e) aura à tout moment le contrôle sur ses Informations Personnelles et disposera d’un mécanisme pour se désabonner de toute communication ultérieure du Commanditaire. Le Commanditaire n’utilisera pas les Informations Personnelles du/de la Participant(e) à d’autres fins.

Exclusion des Garanties ; Limitation des Responsabilités ; Indemnités
Dans cette Section, le terme “Commanditaire” (tel que défini ci-dessous) inclut ses filiales, affiliés, agences de publicité et de promotion, ainsi que tous leurs dirigeants, administrateurs, employés, représentants et agents.
Aucune garantie: DANS LA MESURE MAXIMALE AUTORISÉE PAR LA LOI, LES PRIX ET TOUT SYSTÈME, SITE WEB ET TECHNOLOGIES UTILISÉS DANS LE CADRE DE LA FOURNITURE DU CONCOURS SONT FOURNIS “TEL QUEL”. L’UTILISATION DES PRIX ET DE CES SYSTÈMES, SITES WEB ET TECHNOLOGIES PAR LE/LA PARTICIPANT(E) SE FAIT À SES PROPRES RISQUES SANS AUCUNE GARANTIE (EXPRESSE, IMPLICITE OU STATUTAIRE) QUELLE QU’ELLE SOIT.
Limitation de responsabilité : DANS LA MESURE MAXIMALE AUTORISÉE PAR LA LOI, LE COMMANDITAIRE N’ASSUME AUCUNE RESPONSABILITÉ ENVERS LE/LA PARTICIPANT(E) POUR LES BLESSURES PERSONNELLES OU POUR TOUS DOMMAGES DIRECTS, INDIRECTS, ACCESSOIRES, SPÉCIAUX OU CONSÉCUTIFS QUELCONQUES, DÉCOULANT DE L’ACCEPTATION, DE LA POSSESSION, DE L’UTILISATION OU DE LA MAUVAISE UTILISATION DES PRIX OU DE LA PARTICIPATION À CE CONCOURS OU À TOUTE ACTIVITÉ LIÉE AU CONCOURS OU AU PRIX. POUR TOUTE RESPONSABILITÉ DU COMMANDITAIRE NON LIMITÉE PAR CETTE SECTION, ET DANS LA MESURE NON INTERDITE PAR LA LOI, LA RESPONSABILITÉ TOTALE DU COMMANDITAIRE ENVERS CHAQUE PARTICIPANT(E) POUR TOUS LES DOMMAGES SERA LIMITÉE À DIX DOLLARS (10,00 $) ET ENVERS TOUS LES PARTICIPANTS EN AGRÉGAT À CINQUANTE DOLLARS (50,00 $).
Indemnisation: Le/la Participant(e) accepte d’indemniser, de défendre et de dégager de toute responsabilité le Commanditaire contre tous les dommages, pertes, coûts et dépenses (y compris les frais juridiques) encourus dans le cadre ou découlant de la participation du/de la participant(e) au Concours, de la violation ou de la prétendue violation des Règles du Concours, et/ou de toute négligence ou inconduite liée à la participation au Concours. Le Commanditaire se réserve le droit, à ses propres frais, d’assumer la défense exclusive et le contrôle de toute affaire autrement sujette à indemnisation par le/la participant(e) en vertu des présentes, et le/la participant(e) coopérera pleinement comme raisonnablement requis par le Commanditaire.

Divers
Le Commanditaire se réserve le droit, à sa seule discrétion, de mettre fin au Concours, en tout ou en partie, et/ou de modifier, d’amender ou de suspendre le Concours, et/ou les Règles du Concours de quelque manière que ce soit, à tout moment, et ce, sans préavis. Le Commanditaire n’assume aucune responsabilité pour toute erreur, omission, interruption, suppression, défaut, vol, destruction, ou accès non autorisé, ou altération des participations.
TOUTE TENTATIVE DE LA PART D’UN(E) PARTICIPANT(E) DE MINER, METTRE EN DANGER OU PERTURBER DE QUELQUE MANIÈRE QUE CE SOIT LE DÉROULEMENT LÉGITIME DE CE CONCOURS PEUT CONSTITUER UNE VIOLATION DES LOIS CRIMINELLES ET CIVILES, ET SI UNE TELLE TENTATIVE EST FAITE, LE COMMANDITAIRE SE RÉSERVE LE DROIT, À SA SEULE DISCRÉTION, DE RECHERCHER DES RECOURS ET DES DOMMAGES DE TOUTE PERSONNE IMPLIQUÉE DANS LA MESURE LA PLUS LARGE AUTORISÉE PAR LA LOI ET/OU D’ANNULER, DE METTRE FIN, DE MODIFIER OU DE SUSPENDRE LE CONCOURS.
Dans la mesure du possible, chaque disposition de ces Règles du Concours sera interprétée de manière à être efficace et valide en vertu du droit applicable. Si, toutefois, une disposition de ces Règles du Concours est jugée interdite par, ou invalide en vertu, du droit applicable, cette disposition sera inefficace seulement dans la mesure de cette interdiction ou invalidité, sans invalider le reste de cette disposition ou les autres dispositions de ces Règles du Concours.

Loi Applicable
Ce Concours est régi par les lois de la province de l’Ontario, sans égard à ses principes de conflits de lois. Les Participants conviennent que tous les litiges, controverses ou différends découlant du Concours et des Règles du Concours seront jugés exclusivement devant un tribunal situé à Toronto, en Ontario. Les Participants renoncent délibérément et volontairement à leur droit d’avoir tout litige, controverse ou différend jugé par un jury.

Disparité de Langue
En cas de divergence ou d’incohérence entre les termes et conditions des Règles du Concours et les divulgations ou autres déclarations contenues dans tout matériel lié au Concours, y compris, mais sans s’y limiter, le formulaire de participation au Concours et la publicité imprimée ou en ligne, les termes et conditions des Règles du Concours prévaudront, régiront et contrôleront.
