THE GIVEAWAY IS OPEN TO LEGAL RESIDENTS OF CANADA ONLY. PARTICIPANTS MUST BE OF THE AGE OF MAJORITY IN THEIR PROVINCE OR TERRITORY OF RESIDENCE OR OLDER AT THE TIME OF ENTRY. DO NOT ENTER THIS GIVEAWAY IF YOU ARE NOT ELIGIBLE.

THIS GIVEAWAY SHALL BE VOID, IN WHOLE OR IN PART, WHERE PROHIBITED BY LAW.
ENTRY IN THIS GIVEAWAY CONSTITUTES YOUR ACCEPTANCE OF THE GIVEAWAY RULES.
Eligibility
To be eligible for this Giveaway, an individual must:
- be a legal resident of Canada;
- be of the age of majority in their province or territory at the time of commencement of the Giveaway Period.
Employees, representatives, and mandataries of the Sponsor, any member of the jury selecting the Selected Entrant (if applicable), and its and their respective affiliates, subsidiaries, related companies, advertising and promotional agencies and contest administrators, and any individual residing in the same household as any of the previously listed persons are not eligible to participate in the Giveaway.
The Giveaway Period
Giveaway begins on February 1, 2024 at 7:00PM ET and ends on February 2, 2024 at 11:59PM ET (the “Giveaway Period”).
How to Enter
There is no purchase necessary to enter the Giveaway. To enter, each eligible individual (“Entrant”) must:
- fill in the entry form at the link provided in the email with your full name and email address, and
- complete the ‘wish’ activity (i.e. select and share your ‘wish list’ item from the applicable flyer) (together, the “Tasks”).
It is a condition of entry that the Tasks are completed fully and accurately.
If you have completed the Tasks, you will be automatically entered into the Giveaway and eligible for the Draw. The completed Tasks equals one (1) entry into the Giveaway for the Draw. Entries are limited to one (1) entry per person. Limit of one (1) Prize per person. A random draw will be conducted to draw the Selected Entrant (defined below) of the Draw. Entries are only eligible for the Draw if received during the Giveaway Period.
To obtain one (1) entry in the Giveaway without needing to complete the Tasks, print your first name, last name, complete mailing address (including postal/zip code), valid email address, telephone number, and the date on a plain piece of paper and mail it (in an envelope with sufficient postage) to: Flipp Operations Inc., 350-3250 Bloor St W, Toronto, ON, M8X 2X9. Attn: Consumer Research – February 1 Wish & Win Giveaway Entry (the “Request”). Upon receipt of a valid Request in accordance with these Rules, you will receive one (1) entry in the Giveaway. As above, entries are limited to one (1) entry per person. To be eligible to enter the Draw, the Request must: (i) be received separately in an envelope bearing sufficient postage (i.e. multiple Requests in the same envelope will be void); and (ii) be post-marked during the Giveaway Period and received by no later than the end of the Giveaway Period.
Conditions of Entry
By entering, Entrants agree to accept, abide by and acknowledge compliance with these Giveaway Rules, including but not limited to all eligibility requirements, and the decisions of Sponsor, whose rules and decisions are final and binding on all Entrants.
Entrants agree to abide by all the terms and conditions of all implicated third-party platforms, including Gleam, as applicable.
Entrants agree that Sponsor is free to use any information provided to Sponsor in accordance with these Giveaway Rules, including, but not limited to, the uses as outlined in the section entitled “Privacy and Use of Personal Information”.
The Draws
On or about the Draw Time, Sponsor will randomly select, using a random number generator, one (1) Entrant from the pool of eligible Entrants (the “Selected Entrant”).
Odds of winning are dependent on the number of eligible entries received and the number of Entrants on the respective platform.
Prizes
The Prize is one gift card for everythingcard (e-gift certificate only) for the Draw Time, valued at approximately CAD $300.00. The Prizes will be sent to the winners via email.
Sponsor reserves the right to substitute an alternate prize of equal or greater value if an advertised prize is unavailable at the time of award.
Additional Conditions for Winning
The Selected Entrant must also correctly answer unaided, a time limited, mathematical, skill-testing question and sign a standard declaration and release form.
Failure to comply with all the terms and conditions in the Giveaway Rules will result in disqualification and an alternate Entrant will be selected in accordance with these Giveaway Rules.
Any attempt or suspected attempt to use robotic, automatic, programmed or otherwise illicit means to enter the Giveaway, or any other methods not authorized by these Giveaway Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. Entries that contain false or incomplete information are void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Giveaway Rules are void. Entrants grant Sponsor a non-exclusive license to use all entries for any purpose. No correspondence will be entered into except with Selected Entrants. Proof of transmission (for example, screenshots or captures) does not constitute proof of entry or receipt of an entry.
The Sponsor reserves the right to terminate or amend this Giveaway at any time and in any way, without prior notice to entrants. Without limiting the foregoing, if, for any reason, the Giveaway is not capable of running as originally planned for any reason, the Sponsor reserves the right to cancel the Giveaway and conduct a random draw from all previously-received eligible entries received during the Giveaway Period.
Prize Redemption
The Selected Entrant will be notified via email (as submitted by the Selected Entrant through Gleam) within five (5) business days of the Draw Time. The Selected Entrant must respond to the email within forty-eight (48) hours of the notification with all the information requested. Examples of required information may include, but is not limited to:
- Selected Entrant’s mailing address
- Selected Entrant’s email address
- Selected Entrant’s place of residence (province/territory)
- Selected Entrant’s age
- the correct answer to the mathematical skill-testing question
As a prerequisite for receiving the prize, the Selected Entrant shall also be required to sign a declaration and release form. The completed and signed copy of the declaration and release form may be sent (i) via email (i.e. in scanned format such as Adobe® PDF), (ii) via courier or registered mail, or (iii) via fax (number to be provided in the notice). Failure to provide a full and valid response (such as not providing all information requested, not executing the declaration and release form to the full satisfaction of the Sponsor or failing to answer the mathematical skill-testing question correctly) will result in the Selected Entrant being disqualified and an alternative Entrant being selected in accordance with the Giveaway Rules. No extension will be given, regardless of the circumstances. There are no exceptions; please do not ask. The Sponsor is not responsible for a Selected Entrant’s failure to respond to the notice in a timely manner or to provide an incomplete or incorrect response.
THE DECLARATION AND RELEASE FORM IS AN IMPORTANT LEGAL DOCUMENT SO PLEASE READ CAREFULLY. THE FORM INCLUDES, AMONG OTHER THINGS, (I) A RELEASE IN FAVOUR OF THE SPONSOR THAT ABSOLVES THE SPONSOR FROM ANY AND ALL LIABILITY FOR ANY LOSS, HARM, DAMAGES, COST OR EXPENSE ARISING OUT OF PARTICIPATION IN THIS GIVEAWAY, (II) AN INDEMNITY FOR THE BENEFIT OF THE SPONSOR FOR ANY DAMAGES, COST OR EXPENSES SUFFERED BY THE SPONSOR FROM A SELECTED ENTRANT’S BREACH, NEGLIGENCE OR MISCONDUCT IN CONNECTION WITH ITS PARTICIPATION IN THE GIVEAWAY, AND (III) A DECLARATION TO CERTAIN FACTS UPON WHICH THE SPONSOR RELIES FOR THE PURPOSE OF CONDUCTING THE GIVEAWAY. THE SPONSOR ENCOURAGES YOU TO SEEK PROFESSIONAL LEGAL OPINION BEFORE EXECUTING THE DOCUMENT.
Within a reasonable time following the receipt of the Selected Entrant’s full and valid response, the Sponsor shall send the respective Prize to the Selected Entrant. The Sponsor is not responsible if the Prize is lost, stolen or mutilated. No replacement will be provided. The value of the prize may be taxable as income; any and all applicable taxes, fees, duties and surcharges on the Prize and/or the redemption thereof are the sole responsibility of the Selected Entrant.
Privacy and Use of Personal Information
By participating in the Giveaway, Entrant (a) grants to the Sponsor the right to use all information provided to the Sponsor in connection with the Giveaway, including, but not limited to, the Entrant’s name, mailing address, and e-mail address (“Personal Information”) for the purpose of administering the Giveaway; and (b) acknowledges that the Sponsor may disclose his/her Personal Information to third-party agents and service providers of any of the Sponsor for the purpose of administering the Giveaway. The Sponsor may announce publicly the Selected Entrant’s name and province of residence, and by participating in this Giveaway, the Selected Entrant is deemed to have consented to the publishing of this information.
The Sponsor will use the Entrant’s Personal Information only for identified purposes, and protect the Entrant’s Personal Information in a manner that is consistent with its privacy policy. The Entrant will at all times have control over its Personal Information and will be provided with a mechanism to unsubscribe to any further communications from the Sponsor. The Sponsor will not use Entrant’s Personal Information for any other purpose.

This Section shall survive the termination or expiry of the Giveaway.
Exclusion of Warranties; Limitation of Liabilities; Indemnities
In this Section, the term “Sponsor” (as defined below) includes its subsidiaries, affiliates, advertising and promotional agencies, and all of their officers, directors, employees, representatives and agents.
No Warranties: TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PRIZES AND ANY SYSTEMS, WEBSITES AND TECHNOLOGIES USED IN CONNECTION WITH THE PROVISION OF THE GIVEAWAY ARE PROVIDED “AS-IS”. ENTRANT’S USE OF THE PRIZES AND SUCH SYSTEMS, WEBSITES AND TECHNOLOGIES IS AT ITS SOLE RISK WITH NO WARRANTIES (INCLUDING IMPLIED, EXPRESS OR STATUTORY) WHATSOEVER.
Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPONSOR SHALL HAVE NO LIABILITY TO THE ENTRANT FOR PERSONAL INJURY, OR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES WHATSOEVER, IN CONNECTION WITH OR ARISING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES OR PARTICIPATION IN THIS GIVEAWAY OR PARTICIPATION IN ANY GIVEAWAY OR PRIZE RELATED ACTIVITY. FOR ANY LIABILITY OF THE SPONSOR NOT LIMITED BY THIS SECTION, AND TO THE EXTENT NOT PROHIBITED BY LAW, THE SPONSOR’S TOTAL LIABILITY TO EACH ENTRANT FOR ALL DAMAGES SHALL BE LIMITED TO TEN DOLLARS ($10.00) AND TO ALL ENTRANTS IN THE AGGREGATE SHALL BE LIMITED TO FIFTY DOLLARS ($50.00).
Indemnity: Entrant agrees to indemnify, defend and hold harmless Sponsor from any damages, losses, costs and expenses (including legal fees), incurred in connection with or arising from Entrant’s participation in the Giveaway, breach or alleged breach of the Giveaway Rules, and/or any negligence or misconduct in connection with the participation in the Giveaway. Sponsor reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by Entrant hereunder, and Entrant shall cooperate fully as reasonably required by Sponsor.
This Section shall survive the termination or expiry of the Giveaway.
Miscellaneous
The Sponsor reserves the right, in its sole discretion, to terminate the Giveaway, in whole or in part, and/or modify, amend or suspend the Giveaway, and/or the Giveaway Rules in any way, at any time, for any reason without prior notice. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, theft or destruction or unauthorized access to, or alteration of, entries.
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY UNDERMINE, JEOPARDIZE OR IN ANY WAY DISRUPT THE LEGITIMATE OPERATION OF THIS GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW AND/OR CANCEL, TERMINATE, MODIFY OR SUSPEND THE GIVEAWAY.
Whenever possible, each provision of these Giveaway Rules shall be interpreted so as to be effective and valid under applicable law. If, however, any provision of these Giveaway Rules is held to be prohibited by, or invalid under, applicable law, such provision shall be ineffective only to the extent of such prohibition or invalidity, without invalidating the remainder of such provision or the other provisions of these Giveaway Rules.
Quebec Litigation: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
This Section shall survive the termination or expiry of the Giveaway.

Governing Law
This Giveaway is governed by the laws of the Province of Ontario without regard to its conflict of laws principles. Entrants agree that all disputes, controversies or differences whatsoever arising in connection with the Giveaway and the Giveaway Rules shall be adjudicated exclusively in and before a court located in Toronto, Ontario. Entrants knowingly and voluntarily waive their rights to have any disputes, controversies or differences tried and adjudicated by a jury.
This Section shall survive the termination or expiry of the Giveaway.
Language Discrepancy
In the event of any discrepancy or inconsistency between the terms and conditions of the Giveaway Rules and disclosures or other statements contained in any Giveaway-related materials, including but not limited to the Giveaway entry form, and print or online advertising, the terms and conditions of the Giveaway Rules shall prevail, govern and control.
In the event of any discrepancy between the original English version of these Terms and Conditions and the French version, the English version prevails.
This Section shall survive the termination or expiry of the Giveaway.

Admissibilité

La période du concours
Le Concours commence le 1 février 2024 à 19h00 HE et se termine le 2 février 2024 à 23h59 HE (la « Période du concours »).
Comment participer
Aucun achat n’est nécessaire pour participer au Concours. Pour participer, chaque personne éligible (« Participant ») doit :
- remplissez le formulaire de participation au lien fourni dans le courriel en indiquant votre nom complet et votre adresse électronique, et
- complétez l’activité du « voeu » (c’est-à-dire sélectionner et partager votre « liste de voeux » dans la circulaire applicable) (ensemble, les « Tâches »).
La condition d’entrée est que les Tâches soient remplies de manière complète et précise.
Si vous avez rempli les Tâches, vous serez automatiquement inscrit au Concours et admissible au Tirage. Les Tâches complétées équivalent à une (1) participation au Concours pour le Tirage. Les participations sont limitées à une (1) participation par personne. Limite d’un (1) Prix par personne. Un tirage sera effectué pour désigner le participant sélectionné (défini ci-dessous) pour le Tirage. Conditions d’admission
En s’inscrivant, les Participants acceptent de se conformer aux Règles du concours, y compris, mais sans s’y limiter, à toutes les conditions d’admissibilité, et aux décisions du Commanditaire, lesquelles règles et décisions sont définitives et contraignantes pour tous les Participants.

Les tirages

Les chances de gagner dépendent du nombre d’inscriptions admissibles reçues et du nombre de Participants sur la plate-forme concernée.
Prix
Le prix est une carte-cadeau de everythingcard (chèque-cadeau électronique uniquement) pour l’Heure du tirage, d’une valeur d’environ 300,00 $ CAD. Les prix seront envoyés aux gagnants par courriel.
Le Commanditaire se réserve le droit de substituer un autre prix de valeur égale ou supérieure si un prix annoncé n’est pas disponible au moment de l’attribution.
Conditions supplémentaires pour gagner
Le Participant sélectionné doit également répondre correctement, sans aide, à une question d’aptitude mathématique dans un temps limité et signer un formulaire standard de déclaration et de décharge.
Si les conditions générales des Règles du concours ne sont pas respectées, le participant sera disqualifié et un autre Participant sera sélectionné conformément aux Règles du concours.
Toute tentative ou soupçon de tentative d’utilisation de moyens robotiques, automatiques, programmés ou autrement illicites pour participer au Concours, ou toute autre méthode non autorisée par les Règles du concours, par exemple, mais sans s’y limiter, la création de comptes, d’identités ou d’inscriptions multiples, à la seule discrétion du Commanditaire, sera considérée comme une falsification et pourra vous disqualifier de la participation et/ou du gain d’un prix. Les inscriptions qui contiennent des informations fausses ou incomplètes sont nulles. Les inscriptions en retard, perdues, volées, illisibles, contenant de fausses informations, endommagées, mal adressées, mutilées, déformées ou incomplètes, altérées ou autrement irrégulières ou qui ne sont pas conformes ou ne satisfont pas à l’une ou à toutes les conditions des Règles du concours sont nulles. Les Participants accordent au Commanditaire une licence non exclusive pour utiliser tous les bulletins de participation à quelque fin que ce soit. Aucune correspondance ne sera échangée, sauf avec les Participants sélectionnés. Les preuves de transmission (par exemple, les captures d’écran ou les captures) ne constituent pas une preuve de participation ou de réception d’une participation.
Le Commanditaire se réserve le droit de mettre fin ou de modifier ce Concours à tout moment et de quelque manière que ce soit, sans préavis aux participants. Sans limiter ce qui précède, si, pour quelque raison que ce soit, le Concours ne peut pas se dérouler comme prévu initialement, le Commanditaire se réserve le droit d’annuler le Concours et de procéder à un tirage au sort parmi tous les bulletins de participation admissibles reçus précédemment pendant la Période du concours.
Remise des prix
Le Participant sélectionné sera informé par courriel (tel que soumis par le Participant sélectionné via Gleam) dans les cinq (5) jours ouvrables suivants l’Heure du tirage. Le Participant sélectionné doit répondre au courriel dans les quarante-huit (48) heures suivant la notification en fournissant toutes les informations demandées. Comme condition préalable à la réception du prix, le Participant sélectionné devra également signer un formulaire de déclaration et de décharge. La copie remplie et signée du formulaire de déclaration et de décharge peut être envoyée (i) par courriel (c’est-à-dire en format numérisé tel que Adobe® PDF), (ii) par courrier ou courrier recommandé, ou (iii) par télécopie (numéro à indiquer dans l’avis). Si le participant sélectionné ne fournit pas une réponse complète et valide (par exemple, s’il ne fournit pas toutes les informations demandées, s’il ne signe pas le formulaire de déclaration et de décharge à la satisfaction du Commanditaire ou s’il ne répond pas correctement à la question réglementaire d’arithmétique), il sera disqualifié et un autre Participant sera sélectionné conformément au règlement du Concours. Aucune prolongation ne sera accordée, quelles que soient les circonstances. Il n’y a pas d’exception ; veuillez ne pas demander. Le Commanditaire n’est pas responsable du fait qu’un participant sélectionné ne réponde pas à l’avis en temps voulu ou fournisse une réponse incomplète ou erronée.
LE FORMULAIRE DE DÉCLARATION ET DE DÉCHARGE EST UN DOCUMENT JURIDIQUE IMPORTANT, VEUILLEZ LE LIRE ATTENTIVEMENT. LE FORMULAIRE COMPREND, ENTRE AUTRES (I) UNE DÉCHARGE EN FAVEUR DU COMMANDITAIRE QUI L’EXONÈRE DE TOUTE RESPONSABILITÉ POUR TOUTE PERTE, TOUT PRÉJUDICE, TOUT DOMMAGE, TOUT COÛT OU TOUTE DÉPENSE DÉCOULANT DE LA PARTICIPATION À CE CONCOURS (II) UNE INDEMNITÉ AU PROFIT DU COMMANDITAIRE POUR TOUT DOMMAGE, TOUT COÛT OU TOUTE DÉPENSE SUBIS PAR LE COMMANDITAIRE EN RAISON D’UN MANQUEMENT, D’UNE NÉGLIGENCE OU D’UNE INCONDUITE DE LA PART D’UN PARTICIPANT SÉLECTIONNÉ DANS LE CADRE DE SA PARTICIPATION AU CONCOURS, ET (III) UNE DÉCLARATION RELATIVE À CERTAINS FAITS SUR LESQUELS LE COMMANDITAIRE S’APPUIE POUR MENER À BIEN LE CONCOURS. LE COMMANDITAIRE VOUS ENCOURAGE À DEMANDER UN AVIS JURIDIQUE PROFESSIONNEL AVANT DE SIGNER LE DOCUMENT.
Dans un délai raisonnable après la réception de la réponse complète et valide du Participant sélectionné, le Commanditaire enverra le Prix respectif au Participant sélectionné. Le Commanditaire n’est pas responsable si le Prix est perdu, volé ou endommagé. Aucun remplacement ne sera fourni. La valeur du prix peut être imposable en tant que revenu ; tous les impôts, taxes, droits et surtaxes applicables au Prix et/ou à l’échange de celui-ci sont de la seule responsabilité du Participant sélectionné.
Confidentialité et utilisation des informations personnelles
En participant au Concours, le Participant (a) accorde au Commanditaire le droit d’utiliser toutes les informations fournies au Commanditaire dans le cadre du Concours, y compris, mais sans s’y limiter, le nom, l’adresse postale et l’adresse électronique du Participant (les « Informations personnelles ») dans le but de gérer le Concours ; et (b) reconnaît que le Commanditaire peut divulguer ses Informations personnelles à des agents tiers et à des prestataires de services de l’un des Commanditaires dans le but de gérer le Concours. Le Commanditaire peut annoncer publiquement le nom et la province de résidence du Participant sélectionné, et en participant à ce Concours, le Participant sélectionné est réputé avoir consenti à la publication de ces informations.
Le Commanditaire n’utilisera les renseignements personnels du Participant qu’aux fins identifiées et les protégera d’une manière conforme à sa politique de confidentialité. Le Participant aura en tout temps le contrôle de ses renseignements personnels et disposera d’un mécanisme lui permettant de se désabonner de toute autre communication du Commanditaire. Le Commanditaire n’utilisera pas les renseignements personnels du Participant à d’autres fins.

Exclusion des garanties ; limitation des responsabilités ; indemnisations
Dans cette Section, le terme « Commanditaire » (tel que défini ci-dessous) inclut ses filiales, sociétés affiliées, agences de publicité et de promotion, ainsi que tous leurs dirigeants, administrateurs, employés, représentants et agents.
Aucune garantie : DANS TOUTE LA MESURE PERMISE PAR LA LOI, LES PRIX ET TOUS LES SYSTÈMES, SITES WEB ET TECHNOLOGIES UTILISÉES DANS LE CADRE DE L’ORGANISATION DU CONCOURS SONT FOURNIS ” EN L’ÉTAT “. L’UTILISATION PAR LE PARTICIPANT DES PRIX ET DE CES SYSTÈMES, SITES WEB ET TECHNOLOGIES SE FONT À SES RISQUES ET PÉRILS, SANS AUCUNE GARANTIE (IMPLICITE, EXPRESSE OU LÉGALE) DE QUELQUE NATURE QUE CE SOIT.
Limitation de la responsabilité : DANS LA MESURE MAXIMALE PERMISE PAR LA LOI, LE COMMANDITAIRE N’EST PAS RESPONSABLE ENVERS LE PARTICIPANT DES BLESSURES CORPORELLES OU DES DOMMAGES DIRECTS, INDIRECTS, ACCESSOIRES, SPÉCIAUX OU CONSÉCUTIFS, QUELS QU’ILS SOIENT, LIÉS OU DÉCOULANT DE L’ACCEPTATION, DE LA POSSESSION, DE L’UTILISATION OU DE LA MAUVAISE UTILISATION DES PRIX OU DE LA PARTICIPATION À CE CONCOURS OU À TOUTE ACTIVITÉ LIÉE AU CONCOURS OU AUX PRIX. POUR TOUTE RESPONSABILITÉ DU COMMANDITAIRE NON LIMITÉE PAR CETTE SECTION, ET DANS LA MESURE OÙ LA LOI NE L’INTERDIT PAS, LA RESPONSABILITÉ TOTALE DU COMMANDITAIRE ENVERS CHAQUE PARTICIPANT POUR TOUS LES DOMMAGES SERA LIMITÉE À DIX DOLLARS (10,00 $) ET ENVERS TOUS LES PARTICIPANTS DANS L’ENSEMBLE SERA LIMITÉE À CINQUANTE DOLLARS (50,00 $).
Indemnisation : le Participant accepte d’indemniser, de défendre et de dégager de toute responsabilité le Commanditaire en cas de dommages, pertes, coûts et dépenses (y compris les honoraires d’avocat), encourus en relation ou découlant de la participation du Participant au Concours, de la violation ou de la prétendue violation des Règles du Concours, et/ou de toute négligence ou inconduite en relation avec la participation au Concours. Le Commanditaire se réserve le droit, à ses propres frais, d’assumer la défense et le contrôle exclusifs de toute question faisant l’objet d’une indemnisation par le Participant en vertu des présentes, et le Participant devra coopérer pleinement dans la mesure où le Commanditaire l’exige raisonnablement.

Divers
Le Commanditaire se réserve le droit, à sa seule discrétion, de mettre fin au Concours, en totalité ou en partie, et/ou de modifier, amender ou suspendre le Concours et/ou les Règles du concours de quelque manière que ce soit, à tout moment, pour quelque raison que ce soit et sans préavis. Le Commanditaire n’assume aucune responsabilité en cas d’erreur, d’omission, d’interruption, de suppression, de défaut, de vol ou de destruction, d’accès non autorisé ou d’altération des inscriptions.
TOUTE TENTATIVE PAR UN PARTICIPANT DE NUIRE DÉLIBÉRÉMENT, DE METTRE EN PÉRIL OU DE PERTURBER DE QUELQUE MANIÈRE QUE CE SOIT LE FONCTIONNEMENT LÉGITIME DE CE CONCOURS PEUT CONSTITUER UNE VIOLATION DES LOIS PÉNALES ET CIVILES ET SI UNE TELLE TENTATIVE EST FAITE, LE COMMANDITAIRE SE RÉSERVE LE DROIT, À SA SEULE DISCRÉTION, DE DEMANDER DES RECOURS ET DES DOMMAGES-INTÉRÊTS À UNE TELLE PERSONNE DANS TOUTE LA MESURE PERMISE PAR LA LOI OU D’ANNULER, DE METTRE FIN, DE MODIFIER OU DE SUSPENDRE LE CONCOURS.
Si possible, chaque disposition de ces Règles de participation au concours sera interprétée de manière à être efficace et valide en vertu de la loi applicable. Toutefois, si une disposition des présentes Règles de participation est considérée comme interdite ou invalide en vertu de la loi applicable, cette disposition ne sera effective que dans la mesure où elle est interdite ou invalide, sans invalider le reste de la disposition ou les autres dispositions des présentes Règles de participation.
Litige au Québec : tout litige concernant la conduite ou l’organisation d’un concours publicitaire peut être soumis à la Régie des alcools, des courses et des jeux afin qu’elle se prononce. Tout litige concernant l’attribution d’un prix peut être soumis à la Régie uniquement dans le but d’aider les parties à parvenir à un règlement.

Loi applicable
Ce Concours est régi par les lois de la province de l’Ontario, sans tenir compte des principes de conflit de lois. Les Participants acceptent que tout litige, toute controverse ou tout différend de quelque nature que ce soit en rapport avec le Concours et les Règles du concours soient jugés exclusivement devant un tribunal situé à Toronto, en Ontario. Les Participants renoncent sciemment et volontairement à leur droit de faire juger et trancher par un jury tout litige, controverse ou différend.
La présente Section restera en vigueur après la résiliation ou l’expiration du Concours.
Divergence linguistique
En cas de divergence ou d’incohérence entre les conditions générales des Règles du concours et les divulgations ou autres déclarations contenues dans tout matériel lié au Concours, y compris, mais sans s’y limiter, le formulaire de participation au Concours et la publicité imprimée ou en ligne, les conditions générales des Règles du concours prévaudront, régiront et contrôleront.
En cas de divergence entre la version originale anglaise des présentes conditions générales et la version française, la version anglaise prévaut.
